These Terms of Service ("Terms") govern your access to and use of the website at yfaceviral.com and the related application (collectively, the "Service"), operated by [YOUR LEGAL NAME]. By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract under the law of the jurisdiction in which you reside. If you accept these Terms on behalf of an entity, you represent that you have authority to bind that entity.

2. The Service

YFaceViral is an AI agent that researches, drafts, narrates, edits, and (when you authorize) uploads short and long-form videos to YouTube and other supported platforms. We provide the software, the AI processing pipeline, the storage, and the upload integrations; you provide the topics, niches, and editorial oversight, and you own the resulting videos.

3. Your account

You are responsible for safeguarding your login credentials and for any activity that happens under your account. Notify us at support@yfaceviral.com immediately if you suspect unauthorized access.

4. YouTube and third-party integrations

Connecting a YouTube channel is voluntary. When you do, you grant the Service the permissions described on Google's OAuth consent screen, and you agree to be bound by the YouTube Terms of Service and the Google Privacy Policy. You can revoke our access at any time at https://myaccount.google.com/permissions. We use YouTube data solely to upload the videos you approve, as described in our Privacy Policy.

5. Acceptable use

You agree not to:

  • Use the Service to generate or upload content that is unlawful, defamatory, infringing, hateful, harassing, sexually explicit involving minors, or that promotes violence.
  • Use the Service to impersonate a real person or organization, or to create content designed to mislead viewers about its authenticity in a way that violates the YouTube Community Guidelines.
  • Spam YouTube, attempt to manipulate view counts or engagement metrics, or otherwise violate the YouTube Community Guidelines or YouTube's API Services Terms of Service.
  • Reverse engineer, decompile, scrape, or attempt to derive the source code of the Service, except to the extent that applicable law expressly prohibits this restriction.
  • Use the Service to build a competing product, train a competing AI model, or resell access to the underlying AI APIs.
  • Attempt to bypass rate limits, quotas, or tier restrictions, including by creating multiple accounts.
  • Interfere with the Service's operation or security, or attempt to gain unauthorized access to other users' accounts.

We may suspend or terminate your account for violations, with or without notice.

6. Your content

You retain all ownership rights in the topics, scripts, and other content you provide, and in the videos the Service generates from them. You grant us a limited, non-exclusive licence to process your content as necessary to provide the Service — including sending it to the third-party processors listed in our Privacy Policy. We do not use your content to train any AI model.

You are solely responsible for ensuring you have all rights needed to use any third-party material (music, footage, images, likenesses) you incorporate into your videos.

7. Plans, billing, and refunds

  • The Service is offered on a free tier and on paid subscription tiers as described on the pricing page. Optional one-time credit packs are also available.
  • Subscriptions auto-renew at the end of each billing cycle (monthly or yearly, depending on your selection) until cancelled. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current cycle.
  • We may change prices for future billing cycles with at least 14 days' notice. Continued use after the change takes effect constitutes acceptance.
  • Payments are non-refundable except where required by law or at our discretion. Credit packs are non-refundable once any included credit has been consumed.
  • Taxes (VAT, sales tax) are added at checkout where applicable.

8. Service availability

We aim for high availability but the Service is provided "as is". We do not guarantee uninterrupted operation, and we may impose downtime for maintenance. Generation results depend on third-party AI models whose behaviour we do not control.

9. Intellectual property in the Service

The Service's software, design, brand assets, and documentation are owned by us or our licensors. Nothing in these Terms grants you a licence to those materials beyond what is required to use the Service.

10. Disclaimer of warranties

Except as required by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and freedom from defects.

11. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) £100. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence, or fraud).

12. Indemnity

You agree to indemnify and hold us harmless from any third-party claim arising out of (a) your content, (b) your violation of these Terms, or (c) your violation of the rights of a third party (including YouTube and Google).

13. Termination

You may close your account at any time from the dashboard or by emailing support@yfaceviral.com. We may suspend or terminate your account for breach of these Terms or non-payment. On termination, your right to use the Service ends; sections that by their nature should survive (sections 6, 9, 10, 11, 12, 14) survive.

14. Governing law and venue

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that we may seek injunctive relief in any competent court.

15. Changes

We may update these Terms from time to time. If we make material changes we will notify you by email and post the updated Terms here with a new "Last updated" date at least 14 days before they take effect.
